Rules of the Perekrestok Club Program
General provisions
These Rules define terms of participation in the Perekrestok Club Program in the territory of the Russian Federation. By filling in the Entrance Form and receiving the Participant’s Card the Participant confirms his or her consent with these Rules and undertakes to follow them.
Terms and definitions:
“Perekrestok Club Program” (the “Program”) — relationship whereby the Participant who buys goods and/or services from the Operator and/or the Partners with the use of the Participant’s Card becomes entitled to Privileges under these Rules.
“Privilege” — the possibility to buy goods and/or services from the Operator and/or the Partners with financial or non-financial benefit. Privileges can be provided by way of deferred discount – through accrual of points on the Participant’s Account and subsequent use of such points when buying goods and/or services of the Operator and/or the Partners.
“Participant” — an individual being a holder of the Main or Additional Card permitted by the Operator to participate in the Program in accordance with these Rules.
“Operator” — a legal entity with exclusive rights to manage and develop the Program, being a party to all transactions involving accrual and use of the points under the Program. The Operator can directly sell goods and/or services, in respect of which Privileges are provided to Participants and/or points are accrued by the Operator under the Program (the “eligible goods and services”). LLC “X5 Retail Group” is the Operator of the Program.
“Partners” — companies selling goods and/or services in respect of which Privileges are provided to Participants and/or points are accrued by the Operator under the Program (the “eligible goods and services”). In all acts, connected with accrual and use of points under the Program, the Partners act as agents on behalf and at the expense of the Operator.
“Participant’s Card” — a plastic card that identifies a Participant of the Perekrestok Club Program at the moment of buying goods and/or services from the Operator and/or the Partners. There are two types of the Participant’s Cards: Main Cards and Additional Cards.
“Main Card” — a plastic card purchased by the Participant in accordance with these Rules that enables the Participant to get Privileges and accumulate and use points in accordance with these Rules, and the Operator to monitor information on accrual and use of the points.
“Additional Card” — a plastic card issued to the Participant in accordance with these Rules that enables the Participant to accumulate points and the Operator to monitor accumulation of points. It is not possible to spend the points with the use of the Additional Card.
“Participant’s Account” — an account opened by the Operator in its information system in the name of the Participant (Main Card holder) in accordance with these Rules. The Account is maintained in points. Both the Main Card and the Additional Card are linked to a single Participant’s Account. Points accrue on the Participant’s Account and are redeemed from the Participant’s Account when the Participant buys from the Operator and/or the Partners goods and/or services with the use of the Participant’s Main Card.
Entrance Form — a form handed out by the Operator or on its behalf, which, when filled in and signed by an individual, represents an application by the individual on his or her intention to become a Participant (the Main or Additional Card Holder).
Notification — information, including advertisements, sent to the Participant through one or several means of communication indicated by the Participant in the Entrance Form: by phone (on the Participant’s mobile or home number), by e-mail, by mail sent to the Participant’s postal address or by other means.
1. Participation
1.1. Only individuals not younger than 18 may participate in the Perekrestok Club Program.
1.2. A person wishing to become a Participant should:
1.2.1. Submit an application in form established by the Operator (the Entrance Form), 1.2.2. Pay the entrance fee at the cash desk.
1.3. The Main Card Holder has the right to ask the Operator and/or any of the Partners for Additional Cards (no more than four cards) that will be linked to the Participant’s Account and can be used by any person indicated by the Participant, provided that such person is not younger than 18. Additional Cards are provided free of charge.
1.4. When issuing the Additional Card the Operator or the Partner have the right to charge the delivery cost from the Participant. In case of replacement of a lost Participant’s Card the Operator or the Partner have the right to charge the replacement and delivery costs from the Participant.
1.5. All the Participant’s Cards are property of the Operator and are to be returned to the Operator at his first demand.
1.6. A person can receive only one Participant’s Card. Additional Cards are issued to persons indicated by the Main Card Holder. If a person receives several Participant’s Cards (except replacement of a lost Card), such Participant’s Cards will be blocked and points will not accrue on them.

1.8. The Participant is responsible for safe keeping of the Participant’s Card and prevention of any unauthorized access to it. The Operator and the Partners shall not be responsible for any delay in replacement of the Participant’s Card or for unauthorized use of the Participant’s Card except as provided in paragraph 4.2 of these Rules.
1.9. The Operator has the right to terminate participation in the Program of any Participant without any notice for any reason, including, but not limited:

Participant does not observe these Rules;

Participant abuses the Privileges provided to him or her under the Program;

Participant provides misleading or incorrect information to the Partners and/or the Operator;

Participant has not made any purchases using the Participant’s Card within 12 months after receiving it.
1.10. The Participant has the right to terminate his or her participation in the Perekrestok Club Program or cancel the Additional Card at any time with a written termination notice to the Operator or the Partner.
1.11. The Participant’s Cards are not credit or debit cards, unless other is not stated by the Operator.
1.12. The Participant’s Card shall be valid until the end of the Program unless other is stated in the Rules.
1.13. The Participant undertakes to monitor the data printed on the additional receipt that contains a personal greeting, information on accrued points and other information refered to the Perekrestok Club Program. If the Participant notices that the data printed on the additional receipt does not correspond with the actual data (e.g., wrong name, error message etc.), he or she should call the hotline of the Program within 24 hours.
1.14. In case participation in the Perekrestok Club Program is terminated on the initiative of the Operator (paragraph 1.9 of these Rules) or the Participant (paragraph 1.10 of these Rules) the Operator (Partner) will mark the Participant’s contact details in its database as closed, and within 12 (twelve) months such contact information will be deleted from the Program information system, and the Participant’s points will be deleted as well.
1.15. By accepting the Rules of the Program, Participant agrees to receive from the Operator notifications, stipulated by the Rules, but reserves the right to reject advertising by one of the following means:
2. Points accrual
2.1. Points shall be accrued on the Participant’s Account when the Participant buys the eligible goods and/or services from the Operator or the Partners. Also, points can be accrued on the Participant’s Account in case of promotion actions or gratitude programs offered by the Operator and/or the Partners from time to time. The Operator and the Partners shall determine the list of eligible goods and services and the number of points that shall accrue on the Participant’s Account when the Participant buys such goods and services is determined by the Operator and the Partners.
2.2. In order to receive points the Participant should immediately notify the Partner or the Operator by presenting the Member Card before the purchase of the eligible goods and/or services that the purchase is being made under the Program. The Operator shall not be responsible for not accruing points if the Participant fails to inform the Partner and/or the Operator by presenting the Member card that the purchase has been made under the Program.
2.3. If, for technical reasons, the Participant’s Card could not be read before the sale of goods and/or services, the Participant should claim return of goods and/or service and make the purchase once again, using the Participant’s Card. Otherwise, the complaints about the fact that point were not accrued will be dismissed.
2.4. Points shall be accrued only on the first three receipts per day. For the fourth and subsequent purchases of goods and/or services made on the same day points shall not be accrued.
2.5. If a purchase is paid partially with points and partially with money (cash or bank card), points shall be accrued only on the amount paid with money provided that it exceeds 10 rubles. Certain actions of the Perekrestok Club Program can be exceptions to this rule.
2.6. The Operator alone or jointly with the Partners formulates the rules regulating accrual of points for purchases of goods and services. The current version of the Rules is published on the Operator’s website or in its advertising materials.
2.7. 2.1.Points and rights provided to the Participant cannot be sold, transferred or assigned to other person and shall be used only in accordance with these Rules or on the Operator’s consent. The points shall not have cash form or monetary value.
2.8. Points shall be not accrued for purchases of goods and/or services sold at a discount or at reduced prices. Lists of goods and/or services sold by the Operator and/or the Partners at a discount or at reduced prices shall be published on website http://perekrestok.x5club.ru and provided to the Participant at his or her request at the point of sale.
3. Points redemption for Prvileges.
3.1. The Participant (Main Card Holder) who accumulated points in his or her Account shall have the right to get a Privilege. When the Participant gets a Privilege the points are simultaneously redeemed off his or her Account in accordance with these Rules.
3.2. The Participant can receive Privileges (in which case points will be simultaneously redeemed off his or her Account) after 15 days after purchasing of the Main Card when the personal data of the Main Card Holder is entered into the Operator’s electronic database.
3.3. If the Participant fails to fill in the Entrance Form or its mandatory fields or fills them in incorrectly, he or she will not be able to receive Privileges in exchange for points accrued on his or her Account until he or she fills in the mandatory fields of the Entrance Form correctly. Participant’s Cards shall not be issued to persons who fail to fill in the Entrance Form in due manner.
3.4. In order to redeem off the points Participant (Main Card Holder) should immediately before buying goods or services notify the Partner and/or the Operator that are selling the eligible goods and services under the Program, that the purchase is accompanied by a transaction under the Program. To this end the Participant should present the Participant’s Card at the point of sale and notify the cashier about his or her intention to make full or partial payment with accrued points.
3.5. Points exchanged for the Privilege required by the Participant (Main Card Holder) will be redeemed off the Participant’s Account before granting the Privilege, whereby the points received first will be redeemed first.
3.6. Points exchanged for a Privilege shall not be recovered, even if the Participant (Main Card Holder) waives the Privilege after the points are redeemed. Operator shall redeem any points off the Participant’s Account accrued through error and any points accrued on transactions that were canceled (return of goods).
3.7. All points not exchanged by the Participant for a Privilege within 12 months after their accrual on the Participant’s Account shall be admited as expired and shall be redeemed off the Participant’s Account.
4. Participant’s Card blocking
4.1. If the Participant has lost the Participant’s Card, he or she should call the Perekrestok Club hotline on 8-800-200-9555 and notify the operator about the loss. Then the lost card will be blocked and a new Participant’s Card will be issued to the Participant.
4.2. If any points are written off the lost Participant’s Card after the Participants notified the Operator about the loss, the Operator shall recover such points.
4.3. Points written off before the Participant called on the Perekrestok Club hotline shall not be recovered.
4.4. The Participant’s Card will be blocked two years after it was purchased, and the Participant will have to exchange it for a new one in accordance with the Rules of the Program.
5. Other conditions
5.1. The Operator has the right to change these Rules and the list of Partners and/or Operators at its own discretion at any time. Information on such changes will be published on the Operator’s website ( www.x5club.ru).
5.2. The Operator and/or the Partners reserve the right to change at their own discretion and without notice the list of eligible goods and services, the number of points due to Participants for purchasing of such goods and services, and the list of Privileges available to each Participant.
5.3. The Operator reserves the right to suspend or terminate the Program at any time with a three months notice to the Participant. The Operator shall not be liable for suspension or termination of the Program in respect of any Participant’s Account, including, without limitation, the liability for points on the Participant’s Account at the moment of suspension or termination of the Program.
5.4. The Operator’s liability in respect of goods and services provided under the Program and relevant warranty liability shall be limited by the requirements of the legislation of the Russian Federation.
5.5. The Partners are not authorized to make representations or warranties on behalf of the Operator in excess of their existing authority under these Rules and other documents agreed with the Operator. The Operator makes no commitments in respect of any representations or warranties made by the Partners in excess of their authority.
5.6. Notice on termination or suspension of the Program is considered to be communicated to the Participant on behalf of the Operator, if placed on the Operator’s website ( www.x5club.ru) or communicated in accordance with contact details (mobile or home phone number, e-mail, postal address) indicated by the Participant in the Entrance Form. 5.7. The Participant confirms that all personal data indicated by him or her in the Entrance Form can be used by the Operator or its authorized entities, inside and outside the Russian Federation, only within the framework and for purposes of the Program. 5.8. By signing of the Entrance Form, the Additional Card Holder certifies the correctness of his or her data indicated by the Main Card Holder at the time of purchasing of the Main Card and authorizes the Operator and its authorized entities, inside and outside of the Russian Federation, to use such personal data only within the framework and for purposes of the Perekrestok Club Program. 5.9. Before signing of the Entrance Form, the Additional Card Holder may use the Additional Card for accrual of points, however, his or her access to the hotline or to the website www.x5club.ru can be limited by the Operator and/or the Partners. 5.10. The Participant shall inform all Additional Card Holders about these Rules. 5.11. Participants, participating in special offers and actions of the Perekrestok Club Program, should read the rules of such offers and actions at website www.x5club.ru and follow them.
5.12. Other Rules, not included into these Rules, are published in special sections of the Company website.
6. Dispute resolution
6.2. In case a dispute between the Operator and/or the Partners and the Participant cannot be resolved in accordance with these Rules, it will be resolved in accordance with the current legislation of the Russian Federation.
